Terms of Service
BV Photography LLC Effective date: July 2026
These Terms of Service (“Terms”) govern your purchase of photography products and services from BV Photography LLC, a Florida limited liability company (“BV Photography,” “we,” “us,” “our”), operating as Travel Photo Concierge. By completing a payment through our checkout page, you agree to these Terms.
If you do not agree, do not complete the purchase.
1. What you are buying
You are purchasing a digital photography package: a set of photographs captured during an in-person photography session, delivered to you electronically as digital image files.
No physical goods are shipped. No prints are included unless separately agreed in writing.
2. Price
Our checkout page allows you to enter the amount of your purchase. The amount you enter is the price quoted to you by our photographer or authorized representative at the time of your session. By entering that amount and completing payment, you confirm that it is the price you agreed to pay.
Each completed checkout is a single, separate transaction. Our payment records are the authoritative record of the amounts charged.
3. Payment authorization
By completing checkout, you represent and warrant that:
a) You are the cardholder named on the payment card or payment method used, or you are an authorized user of that card or method;
b) You are authorized to make this purchase and to incur the charge;
c) The email address you provide is an address you control, and you consent to delivery of your photographs to that address;
d) The information you provide at checkout is accurate.
Payments are processed by Stripe. We do not receive or store your full card details.
4. Delivery
We deliver your photographs by sending a download link to the email address you provide at checkout.
- We aim to deliver the same evening as your session.
- Delivery normally occurs within one to two (1–2) days.
- Delivery will occur no later than three (3) days after your session, except in cases outside our reasonable control.
Delivery is complete when we send the download link to the email address you provided. It is your responsibility to provide a correct address and to check your spam or junk folder. If you have not received your link within three days, contact us at info@bluevisionja.com and we will resend it at no charge.
Download links do not expire.
5. Immediate delivery and cancellation rights
You expressly request that we begin delivery of your digital photographs immediately, without waiting for any statutory cancellation or withdrawal period to expire.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction granting a statutory right of withdrawal for digital content, you acknowledge and agree that you lose that right of withdrawal once download of your files begins, and you expressly consent to this.
6. Refunds
Because you are purchasing digital content that cannot be returned once accessed, we do not provide refunds after a download link has been issued to you.
We may, at our sole discretion, offer a partial or full refund or additional images where:
- We are unable to deliver your photographs at all; or
- The number of photographs delivered falls materially short of what was agreed; or
- The technical quality of the photographs falls below our standards.
To request a remedy under this section, contact us at info@bluevisionja.com within thirty (30) days of delivery and describe the issue. We will respond promptly and work with you in good faith. Any remedy granted is at our discretion and does not create an obligation to grant similar remedies in future.
Dissatisfaction with subject matter, expressions, weather, lighting conditions, or the appearance of persons photographed is not a basis for a refund.
7. File retention
We currently retain delivered files on our cloud storage and will make reasonable efforts to honor resend requests for at least twelve (12) months after delivery. We do not guarantee retention beyond that period. Please download and back up your files promptly.
8. Copyright and your license
BV Photography LLC retains all copyright and ownership in all photographs we produce.
Upon payment in full, we grant you a non-exclusive, non-transferable, worldwide license to use the delivered photographs for personal, non-commercial purposes only. This includes printing for personal use, sharing with family and friends, and posting to your personal social media accounts.
This license does not permit you to:
- Sell, license, or otherwise commercially exploit the photographs;
- Use the photographs in advertising, promotion, or any commercial publication;
- Claim authorship of the photographs;
- Remove or alter any copyright notice or watermark.
This license is granted on condition of payment in full and terminates automatically if payment is reversed, charged back, or otherwise not received.
9. Our use of images
We may use photographs from your session for our own marketing, portfolio, website, and social media. If you prefer that we do not, email info@bluevisionja.com and we will remove your images from promotional use.
10. Disputes and chargebacks
If you have any question or concern about a charge, contact us first at info@bluevisionja.com. We respond to all inquiries and will resolve genuine errors quickly.
You acknowledge and agree that:
a) We retain records of each transaction, including the payment authorization, the email address and other details you provided at checkout, all correspondence with you, and delivery and download logs recording the date, time, and IP address of each file access;
b) In the event you initiate a chargeback or payment dispute, we will submit these records to your card issuer as evidence in response to that dispute;
c) Initiating a chargeback for a purchase you made and received is a material breach of these Terms. If you do so, the license granted in Section 8 terminates immediately, you must cease all use of the photographs and delete all copies, and we may pursue recovery of the disputed amount together with any fees and reasonable costs we incur.
11. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to your purchase, on any theory of liability, shall not exceed the amount you paid for the photography package in question.
We are not liable for indirect, incidental, consequential, or punitive damages, or for loss of data, profits, or goodwill.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.
If you are a consumer resident in a jurisdiction whose law grants you rights that cannot be waived by contract, nothing in this section deprives you of those rights.
13. Changes to these Terms
We may update these Terms from time to time. The version in effect at the time of your purchase governs that purchase.
